That's how he answered the question about his opinion concerning Roe v. Wade when he was being confirmed for the D.C. Circuit Court of Appeals.
Plessy v. Ferguson (separate but equal) was also established law before it was overturned by Brown v. Board of Education, albeit that was a unanimous decision. If Roe gets overturned -- or at least weakened to the point of uselessness -- it will be on a 5-4 split.
