7. Surely the State of Hawaii will seek cert whether or not there is an en banc decision.

Of course, a cert. grant is hardly a sure thing but this decision is disastrous to Hawaii. Hawaii has to file a cert. petition. The Heller decision very clearly left the question in Young unanswered. This would appear to be the vehicle for answering the question.

My suspicion is that SCOTUS would grant cert. just to find the right to open carry.
