As a Republican he may (think he has to) weigh the National security if he actually makes a case against more than a few red shirts to fall on their swords.

That as a Republican he will not be able to stomach going down as the architect of the modern day Republican party, if he goes for the throat. Cuts off the head of the snake. As well he could use the excuse that he has to stem any violence that may erupt, ironically started by the very diehards that still would support Trump even if he were a convicted criminal. Go figure


There may even be a few of the more conservative Democrats that don't want that kind of instability it would cause if Trump and half the Senate could be up for criminal prosecution.
