Spent 8 vicious years in court.

If its on the legally and recorded surveyed boundary line, both parties have to agree to it being there (at least in CA). If its on your side, you can take it down, or get a court order for them to do it. If its an inch over on their side, nothing you can do about it.

Talk to a lawyer that knows real estate law there.

They've been your neighbors for 22 years? Have you gotten along otherwise? Something had to precipitate this. Did they get a new dog, or grandkid?
