But doesnt necessarily affect the outcome of the appointment. Too many holes in the Constitution on the issues. I dont think it specifies how, or if, an election can be invalidated. Even a 4-4 vote is a non-decision.
I dont believe there is any way to require a justice to recuse themselves. It is left to their own ethics and morals to make that decision. I dont think even the Chief Justice can require it.
Not sure the court would choose to rule with only 6 justices, which would still be 3 - 3.
