I'm ono lawyer, but I think it has to be ratified by a good percentage of states. At least in the case of the ERA, there seem to be enough holdouts to prevent it from passing. Not naming names, but looking at you Gulf and cowboy states.

Some of the states argue that there are already laws making women equal and state laws against violence. It's the republican's gender version of "all beatings matter".
