I seem to remember reading one or more news reports that Trump is planning on declaring a national emergency as a pretext for using the U.S. military for his mass deportation operation. That seems to imply that he thinks he'll be able to get away with it as commander in chief. There also might be a tie in with his plan to purge our military generals and replace them with Trump loyalists.
