Because of the way it is built, in a high wind that will happen. It isn't a sound structure.

I can see that with the naked eye, and I have no doubt that city planners can see it, as well. There is way too much avenue for lift in the portions that face the sidewalk, street and properties around it.

This isn't about inhibiting liberty, it's about preventing people who build things stupidly then after the fact say "I never imagined that a 30mph wind could have done that!"
