(33,992 posts)Is she more likely or less likely to need to be identified wearing the hijab or not? So the government has a compelling interest in having a photo that looks less like her than one taken with the hijab? That's disingenuous - as is the argument that it needs to be removed because she might be hiding things in it. They didn't insist - generally - that she remove it. Only that she remove it for the photo. If she was hiding something in it, was it only potentially dangerous during the booking photo?
As for the likelihood that she will win - the cases have been going the other way (or police departments have been settling - likely because their counsel has advised them not to waste the money).
