but I don't think it is private property. I sort of remember reading that NYC mandated that the lobby & atria area(s) would remain open to the public, therefore treating this area like a park, etc.

Then again, I could be wrong. Also I remember from my Police days, that one of 2 things had to occur for the charge to be trespass, 1. The building had to have a notice that it was private property and trespassers would be prosecuted (usually a notice on the front door) or 2. The person had to be warned that they were on private property, escorted off and if they returned they would be arrested.

For it to be criminal trespass, it had to be trespass with a crime occurring resulting from that trespass.
