2. And when the legal system is inadequate?

Statutes of limitations pass, and the law is a lagging indicator of societal mores. It's shameful that it took until 1965 to pass basic civil rights legislation that guarantees the rights and freedoms of the Constitution really and truly apply to all citizens. It took decades of toil before 1965 to prepare the legislative ground so that a Civil Rights Act would be enacted. And in the 50 years since then, there has been a constant, concerted effort to deny those rights to citizens on the flimsiest pretexts.

Many of those efforts have failed, but some have succeeded. If we're going to rely solely on due process, we need durable laws that are strictly enforced. Even when we think we've guaranteed voting rights, there are retrograde forces and judges willing to listen who will dismantle those protections and guarantees (cf. Shelby County and the destruction of Section 5 of the Voting Rights Act).

If everyone is content to sit and wait for the legal process to re-engage and clank into activity for the benefit of all citizens, then let's just sit back and wait, and let injustice continue unchecked. Some of us aren't willing to do that, and your concerns are duly noted.
