SCOTUS is eventually going to have to hear a case challenging the state's right to legalize, under the commerce clause and the 10^th Amendment...with the decision either legalizing everywhere or striking down legalization everywhere.

It's not up to Obama or any President. It would be a judicial issue within the purview of the court. So...it's a cogent issue to use as a litmus test.
