That was ONLY if they wanted to participate in the program that offers federal government subsidies. They were, and are, allowed to sell anything they want, whether ACA-compliant or not.

In this case, this is a STATE. The state does not have a health ins. program or contribute to it. It contributes to Medicaid, but that's not what this is.
