(17,502 posts)beyond that, federal laws are the same. Oh yeah, there was that stupid mailing pistol act that Republicans passed and Harding signed in 1927. While the law is still on the books, Nixon made it moot when he created USPS form the Post Office.
All federal and state laws must be followed at gun shows, many of the dealers there are FFLs, and must do background checks. Some states require private sellers to pay an FFL to do back ground check. Under federal law, a private seller is prohibited from doing the background check, that is why "gun show loophole" is a misnomer. Some promoters do it voluntarily and create a mechanism to do it. Cops tend to hang out at gun shows. According to the ATF, criminals rarely buy them at gun shows.
An FFL, in case you don't know, is a Federal Firearms License holder, which is a dealer's license.
