1. It might have been better, when the defendent suggested this sentence,

for Judge Mallory to respond that the defendant could choose to go to the Baptist church on his own, but that, as an elected public official, it would be inappropriate for a judge to impose such a sentence. The Judge could then impose whatever sentence he felt appropriate.
