After Tuesday, Barack Obama will still have over 2 months [View all]
in office. He will still have the power of the Executive Order. He will have the power of the presidential pardon. He will still be in charge of the Executive Branch of the federal government.
Right now, he's busy campaigning hard for Hillary Clinton. She's going to win the election, in part due to the President's enthusiasm and solid support for her campaign. He's treading lightly to avoid any effect on the campaign.
But, on November 9, when it's clear who the next President will be, look out for President Obama. He is going to have some time on his hands - time to make things happen that will help prepare the way for President Clinton.
What will he do? I don't know. He's a President who is full of surprises. I expect that he may shake up the Justice Department on his way out the door. I think we'll see Comey and some other FBI leadership folks hand in their resignations, so that Hillary Clinton will be able to name a new Director right away. I think he will withdraw his appointment of a SCOTUS justice, especially if the Democrats will have a Senate majority. I think he may issue record numbers of presidential pardons, particularly in cases of victimless crimes. I suspect there is a long list on his desk waiting for him to act. There are many things he can do in those two months and a few days.
I do not believe for a minute that President Obama is going to sit back, put his feet up on the Oval Office desk and coast until January 20. That would not me like him at all. I think we're going to get some surprises from him, all discussed with the next President in advance.
Stand up and hold onto your hats. Our lame duck President is passing by and standing tall!
