I am not all that familiar with DNC bylaws and rules, but I am betting that DNC committees are bound by the legal interpretation of DNC bylaws and rules as set forth by its legal counsel. So if this is in the form of a legal opinion by the DNC committee of lawyers that is charged with the interpretation of DNC rules and bylaws, it probably cannot be appealed or voted upon, much the same as a ruling by the party parliamentarian would be binding in an interpretation of Roberts Rules during a meeting without resort to appeal.

Therefore, the RBC would not be able to vote on anything that reinstates more than one half of the Fla and MI delegations. If this is the case, then Howard Dean has just pulled the rug out from under the Hillary campaign.
