Indict Them. Prosecute Them.

Can we hope this is the beginning of what will become the prosecution of Dick Cheney and George W. Bush for war crimes? And after these two, the rest of the cast of criminals who so cavalierly and willfully attempted to subvert - if not end - the rule of law with which this nation has attempted to govern itself for over two centuries? One can hope.

David Swanson, one of the co-founders of AfterDowningStreet.org, creator of ProsecuteBushCheney.org and Washington Director of Democrats.com ( only a partial list of Swanson’s efforts; more here) is now involved in a serious effort to bring Cheney and his wrecking crew to justice.

We urge Attorney General Eric Holder to appoint a non-partisan independent Special Counsel to immediately commence a prosecutorial investigation into the most serious alleged crimes of former President George W. Bush, former Vice President Richard B. Cheney, the attorneys formerly employed by the Department of Justice whose memos sought to justify torture, and other former top officials of the Bush Administration.

Our laws, and treaties that under Article VI of our Constitution are the supreme law of the land, require the prosecution of crimes that strong evidence suggests these individuals have committed. Both the former president and the former vice president have confessed to authorizing a torture procedure that is illegal under our law and treaty obligations. The former president has confessed to violating the Foreign Intelligence Surveillance Act.

We see no need for these prosecutions to be extraordinarily lengthy or costly, and no need to wait for the recommendations of a panel or “truth” commission when substantial evidence of the crimes is already in the public domain. We believe the most effective investigation can be conducted by a prosecutor, and we believe such an investigation should begin immediately.

Two hundred organizations have signed a joint statement urging Attorney General Eric Holder to appoint a special prosecutor for former top officials of the Bush Administration. The complete list of organizations can be found at http://specialprosecutor.us.

The arrogance displayed by Bush Administration officials and their legal advisors where it concerns their contempt, both for the law and those now advocating to bring them to justice, is astonishing. At least weekly, Cheney visits various right-wing radio programs and seemingly clueless mainstream media outlets, as he continues his efforts to re-write the eight-year-long history of lawless activity for which his administration is known globally.

The lack of Congressional interest in this collective criminality is especially alarming. The Democratic Party’s response to an ever-increasing volume of evidence that demands a Special Prosecutor has been shameful, almost co-conspiratorial, silence. Puzzling also is the apparent refusal on the part of hundreds of county prosecutors nationwide to bring charges of murder against George W. Bush - even though former Los Angeles prosecutor Vince Bugliosi provided a step-by-step method in securing indictments in his book, “The Prosecution of George W. Bush for Murder.” Further, none of these prosecutors can plead ignorance of Bugliosi’s book after the successful efforts of Seattle writer Bob Alexander to get a copy of the book into the hands of every prosecutor in the United States from whose jurisdiction a soldier had been sent to die in Bush’s illegal war of opportunity and oil theft in Iraq.

There has to be a way to let ourselves and the world know that we will not allow our nation’s slow but persistent dedication to law and justice be utterly and absolutely destroyed by a collection of murderous political hacks who would have been much more successful operating from the Kremlin circa 1970.

That is, if we are to survive as a nation that claims such dedication.
