Brian Ross and Maddy Sauer Report:

Apr_mark_foley_061002_nrIn addition to explicit sexual language, former Congressman Mark Foley's Internet messages also include repeated efforts to get the underage recipient to rendezvous with him at night.

"I would drive a few miles for a hot stud like you," Foley said in one message obtained by ABC News.

The FBI says it has opened a "preliminary investigation" of Foley's e-mails. Federal law enforcement officials say attempts by Foley to meet in person could constitute the necessary evidence for a federal charge of "soliciting for sex" with a minor on the Internet.

27. If pages were warned 5 years ago about Foley...
then staff would had had to known about the problem. Otherwise, they must had been ghost employees.

The only way staff members would not know about the problem is if they were totally isolated from others. For staff members to maintain their current position and to move up the line or have other openings available to them they would need to network with staff members of other House Members at a minimum.

5. Our local ABC TV station had a report today on Noon News which
showed tape of a former page who said the pages were warned FIVE YEARS AGO to stay away from Foley. The local reporter said this was part of Brian Ross' investigation. This is the first time I have heard that the problem went back FIVE YEARS.

9. Yes, it does indicate prior contact...and just like these IM's/emails are
slowly being released, my guess is that the ones confirming actual contact are coming next...

A pedophile who for 5 years+ has been contacting a bunch of pages and being this "aggressive" and explicit isn't just in it for the "talk"...

My money is on the fact that Foley has actually had sexual liasions (or atleast attempt to have sexual liasions) with these adolescent pages.

My guess that these emails were leaked by parents and victims.....more to come shortly....

12. Never underestimate "what happened in San Diego."
That's always been a pretty good rule of thumb. For all the pretty of San Diego, there is some astonishing rot. This should probably be connected to various Republican tax-dollar-to-campaign-funds money laundering schemes, if anyone here is brave enough to dig through that dumpster.

...how about PRISON for sex criminals? Pardon the expression, but FUCK re-hab'ing Foley ~~ just get him where he cannot do any further harm to children.

This case just gets me ~~ because Foley is a Repuke, he seems to get a pass on what he has done from other members of the majority party in Congress. The man, imo, is a CRIMINAL. Jail time and mandatory reg as a convicted sex offender is too good for the bastard.

Because those Dateline pieces are premised upon an initial communication with a minor that is clearly under the age of consent, and the communications unambiguously involve arranging a meeting in response to an explicit request for sex. They are also arranged in states having very clear statutes for this kind of thing.

Probable cause to arrest turns on bright distinctions in these sorts of situations.

While there's little doubt we'll see more ongoing revelations, if what you have here is a guy engaging in perverted discussions with a 16 or 17 year old and then suggesting they get together for dinner, what you do not have is a clear "solicitation for sex".

Now, don't shoot me. I'm not "defending" anyone or anything. I'm just saying that criminal laws tend to be very specific in defining conduct and circumstances that have to be satisfied.

In the excerpt above, you will notice that it is the teenager who asks "did you pick a night for dinner" - not Foley. Foley's not even the one soliciting anything in the excerpt above.

(and, no, I didn't read the whole transcript because its nauseating)

Some news people on MSNBC said they would not release them all, because they were too graphic, but they did suggest that he DID try to solicit kids for sex specifically.
