Ark. appointee won't seek confirmation
LITTLE ROCK, Ark. --An interim U.S. attorney says a "partisan circus" over his recess appointment makes it impossible for him to receive fair consideration, and he will not seek Senate confirmation to his Arkansas district.

However, Tim Griffin can remain at the post without confirmation under a new provision in the Patriot Act that allow recess appointments to last until the end of a president's term, instead of 120 days. That provision was included in the act's reauthorization last year.

The new rules became fuel for hearings when the Democratic-controlled Congress took power this year, with Sen. Mark Pryor, D-Ark., questioning Griffin's appointment.

"They should do the right thing and name another interim appointment," said Michael Teague, a spokesman for Pryor. "Let's get back to the way the founding fathers saw this process working."

I didn't know the terms of a recess appointment had changed! That really sucks.

1. There have been six US attorneys, highly capable and
well regarded, who have been terminated and replaced by bush sycophants who need no confirmation.

When you combine this with the the Roberts headed supreme court's elimination of the ninety year old practice of "knock and notice" on search warrants, it is easy to see that a declaration of martial law will be unnecessary.

He can just stay in there without any hearings at all!

Edit: And it is NOT a recess appointment. It's a regular appointment of a replacement for a US attorney ordered to resign (failure to do so would result in firing so it gets to the same place). The rules were changed so that there's no Senate confirmation required EVER.
