6 Months Later, Still No Charges Vs. Foley
Source: CBS

Six months after resigning from Congress, former U.S. Rep. Mark Foley remains under criminal investigation for sexually explicit Internet communications with underage boys but has not been charged, authorities said Wednesday.

"I can't really give any more detail other than to say we're still in the preliminary investigative stance and we are working with state authorities," said Debra Weierman, spokeswoman for the FBI's Washington field office.

Federal law generally requires a person to meet or attempt to meet a minor for sex for it to be a crime. However, under laws in some states where the Florida Republican communicated with minors, an attempt to seduce the victim might be enough for a criminal case.

Remember just this week? Attorney General Alberto Gonzales announced : “I’m not going to resign. I’m going to stay focused on protecting our kids.” The FBI is doing what now with this case? Well, we know t now it is still in the "preliminary" stage. Because it would be embarrassing to republicans and the justice department is a political arm of the republican party.

2. Maybe because Foley didn't commit a crime?
What he did was sleazy and morally corrupt, no doubt. However, if he did not proposition the kid, who MUST have been a minor as well, for sex then no crime was committed. Furthermore, indecency in the criminal arena has a different definition than indecency in the normal public arena.

4. Exactly
The crime is in the cover-up. He never touched anyone... that they know about. I mean, if you let that slag suck your dick, would you EVER tell anyone?

7. I thought soliciting a minor for sex over state lines using a phone/computer was a crime?

11. All he had to do was encourage or offer sexual conduct according to the law he helped pass.
As the FBI and the Florida Department of Law Enforcement investigate whether Foley broke the law when he sent sexually explicit Internet messages to congressional pages, they will be armed with cyber crime laws he helped pass, as well as others that impose tough new penalties on child sex offenders.

Florida law prohibits anyone from ”encouraging, offering or soliciting sexual conduct” over the Internet with anyone under 18. Child predators face a minimum of five years in prison and a $5,000 fine, with steeper penalties for repeat offenders.

Congress has also passed laws that impose new penalties on child sex crimes, ranging from five to 25 years in prison.

The new federal law Foley championed is part of a crackdown on child sex solicitation over the Internet, as politicians seize on what state and federal authorities say is an increasing threat to kids from illicit Web pages, online chat rooms, e-mails and other electronic methods.

12. "Maybe because Foley didn't commit a crime?"
Edited on Sat Mar-31-07 11:28 AM by Rebellious Republica
I see a by your statement that you can not say with any certainty , the "Maybe" and the "?", that he with out a doubt is innocent. I believe that if you were for certain you would have said "Because Foley didn't commit a crime!"

The investigation seems to be on the back burner, there in lies the crux of the problem. Because we are only in the "preliminary stages" of the investigation, 6 months later and we are only in the preliminary stages, and know no more than we did when the news first broke. I think the FBI needs to follow Foley's own advice and get aggressive with this investigation. The silence is deafening by the FBI,DOJ and Foley, why?

3. Sound like the Loyal Bushies are doing their jobs.
Protecting the Party Comrades from being investigated and prosecuted for their crimes (which, because they performed by Bushevik Party Comrades, aren't crimes at all to them).

Yes, I imagine the Loyal Bushies who now run the FBI are still in the "preliminary investigative stance" regrding the Loyal Bushies who sent anthrax to the tabloid which printed candid photos of the drunken Bushler daughters, then sent anthrax to Senate Democrats and other "liberal media" members.

To expect justice or truth to come from any orifice of the Loyal Bushie junta is to believe the Ghost of Hitler will rise to investigate and expose any Nazi crimes yet unknown.

10. Did he attempt to seduce a minor in Florida? Inquiring minds want to know!
I don't recall if there was evidence that happened.

At any rate, we got rid of him. I'd say that's a pretty good start. Keeping him around and keeping people upset that he hasn't been charged is a GOOD thing... it provides more pain for the 'thugs than if he simply went away behind bars quietly. Of course, there is the potential for a long drawn-out court case. 8^)
