Court: (Michael) Moore did not defame Iraq veteran

BOSTON - A federal appeals court has ruled that filmmaker Michael Moore did not defame an Iraq War veteran when Moore used a clip from a TV interview without his permission in "Fahrenheit 9/11."

Army Sgt. Peter Damon, who lost his arms when a tire on a Black Hawk helicopter exploded while he and another reservist were servicing it, claimed he was humiliated and emotionally distressed after Moore included the clip in Moore's 2004 documentary criticizing the Bush administration and the war in Iraq.

But the 1st U.S. Circuit Court of Appeals affirmed a federal judge's decision to dismiss Damon's lawsuit against Moore.

Moore said the unanimous decision was total vindication, and noted the three-judge panel included two judges appointed by President Bush. Moore said years of failed lawsuits against his films show his movies are accurate.

"I make movies that point out larger truths ... about what's happening in this country and the world in which we live, and I have to then suffer through an onslaught of attack," Moore said. "At some point, I'm wondering, when do I get to catch a break?"

2. You can't defame...
or be accused of a negative attack simply by quoting someone accurately. I hope someone informs Obama, Jeremiah Wright, and Trinity Church of this fact.

You can be accused of a negative act... but maybe not defamation. The Wright thing is utter nonsense. Perhaps we should blame Bill for apologizing to Wright at the white house as his guest. Apologizing for lying to the American people.



Rev. Jeremiah Wright is angry about quite a few things that America has done over the years. If you don't sympathize with that anger, than maybe you haven't been paying attention, but Obama's candor, and treatment of the issue has been nothing if not presidential, eloquent, stately and very becoming of a man whose roots might lead one to expect a lot of anger. Instead we've seen composure, and compassion. Exactly what I want to see from my leaders.

... the U.S. government had failed to support him.

When it was Michael Moore and HomesForOurTroops and NOT the U.S. Government that built him a specially handicapped-accessible home to live in.
