Justices say First State controls river to Garden State's shoreline

The U.S. Supreme Court tidied up part of a messy, centuries-old Delaware River border squabble Monday with a ruling that gave Delaware a clear veto over energy giant BP's proposed liquefied natural gas pier opposite Claymont.

Opponents of BP's plan hailed the decision as a clear victory for Delaware and its Coastal Zone Act conservation law, while one New Jersey lawmaker warned that it could further sour cross-border relations.

BP's state-endorsed Crown Landing LNG terminal in New Jersey would have been served by a 2,000-foot delivery pier built mostly on top of Delaware's part of the riverbed -- an area Delaware considers off-limits to bulk product delivery structures.

Justice Ruth Bader Ginsburg, writing for a 6-2 majority, branded New Jersey's arguments in authorizing the pier over Delaware's objections "implausible," and said the two states share authority to regulate construction on the river in areas where the full width of the waterway lies inside Delaware.
