Judge says Berlusconi can testify in CIA kidnap case

MILAN, May 14 (Reuters) - A Milan judge ruled on Wednesday that Prime Minister Silvio Berlusconi can be called to testify in a trial of U.S. and Italian spies, who are accused of kidnapping a terrorism suspect in Milan and flying him to Egypt.

Berlusconi is not accused of any crime and would appear as a witness called to speak on the tricky issue of state secrets in the case. Italy's former spy chief says classified documents prove his innocence.

The 71-year-old Italian prime minister could become the first head of government in the world to testify in criminal proceedings over secret U.S. transfers of terrorism suspects, known as renditions.

Judge Oscar Magi ruled that former prime minister Romano Prodi, who handed over to Berlusconi last week, can also be called to testify on the same issue.
