PORTLAND -- Federal prosecutors say they will appeal the dismissal of charges against a former Republican official who was cleared of taking part in a plot to jam Democratic phone lines in New Hampshire on Election Day 2002.

U.S. District Judge George Singal ruled last month that bringing new charges against James Tobin, a former GOP organizer from Bangor, qualified as a vindictive prosecution. Prosecutors filed a notice of appeal Tuesday in U.S. District Court in Portland.
