Lawyer: Ex-US officials must face torture charges

MADRID (AP) — One of the lawyers behind a complaint accusing six former Bush administration officials with sanctioning the torture of terror suspects urged the American officials Monday to come to Spain to face justice.

If they are innocent they shouldn't be afraid, human rights lawyer Gonzalo Boye told The Associated Press in an interview Monday.

The case against the American officials — including former Attorney General Alberto Gonzales and former Undersecretary of Defense Douglas Feith — was brought by human rights lawyers before Spain's investigative judge Baltasar Garzon, who has sent it on to prosecutors to see if the charges merit a full investigation.

It alleges the men gave legal cover to the torture of terrorism suspects at Guantanamo Bay, Cuba, by claiming that the U.S. president could ignore the Geneva Conventions and by adopting an overly narrow legal definition of torture.

Spanish Court Weighs Inquiry on Torture for 6 Bush-Era Officials

LONDON — A Spanish court has taken the first steps toward opening a criminal investigation into allegations that six former high-level Bush administration officials violated international law by providing the legal framework to justify the torture of prisoners at Guantánamo Bay, Cuba, an official close to the case said.

The case, against former Attorney General Alberto R. Gonzales and others, was sent to the prosecutor’s office for review by Baltasar Garzón, the crusading investigative judge who ordered the arrest of the former Chilean dictator Augusto Pinochet. The official said that it was “highly probable” that the case would go forward and that it could lead to arrest warrants.

The move represents a step toward ascertaining the legal accountability of top Bush administration officials for allegations of torture and mistreatment of prisoners in the campaign against terrorism. But some American experts said that even if warrants were issued their significance could be more symbolic than practical, and that it was a near certainty that the warrants would not lead to arrests if the officials did not leave the United States.

The complaint under review also names John C. Yoo, the former Justice Department lawyer who wrote secret legal opinions saying the president had the authority to circumvent the Geneva Conventions, and Douglas J. Feith, the former under secretary of defense for policy.

1. Dickless is not among the six?
That's OK if they get one of these guys on the stand he'll give up Cheney in a heartbeat.

I'm anticipating the day when dickless can't even go to Mexico to shoot wild pigs without fear of being arrested.

2. I'm glad to see it happening... but it's sad that it has to come from
outside the US. We should show the world we're a peaceable nation by holding our own war criminals accountable.

I always love such utterances.

Suppose you read in the papers that a grand jury has been empaneled to investigate some charges against "Judi Lynn" and you read that it would be a good idea for you to get a good lawyer.

Then you read, "If Judi is innocent she shouldn't be afraid."

If nothing else, you'd have 6 months of legal bills from a "good lawyer" to contend with.

I've tangentially been on the receiving end of "if Igel is innocent he shouldn't be afraid"; fortunately, I didn't have to cover my own legal bills. And yet, it was done to intimidate and to instill fear--mistakes happen, people misspeak, technicalities become legal obstacles. How many innocent people go to jail, having failed the "reasonable doubt" standard, much less been found culpable under the more lax "preponderance of evidence" standard?

None, apparently, according to that human rights lawyer. Note this completely ignores the actual issue of guilt or innocence. It shows that the human rights lawyer is, well, a lawyer.

10. Judi – I have followed all these stories – I am ashamed to be an american.
I truly believed this nation once stood for something.

I truly wish it were the American people that were playing with macramé knots and lampposts.
