(Spanish) Judge wants to keep Gitmo case alive (investigation of the Bush Six)

MADRID, Spain (CNN) — A Spanish judge moved Friday to keep alive an investigation into six former Bush administration officials for alleged torture of prisoners at the U.S. detention camp for terrorism suspects at Guantanamo Bay. Cuba.

He acted just hours after prosecutors urged the case to be dropped, according to a court document.

10. I don't think you're correct here -
the judge, as I understand it, is the final authority on whether or not this project goes forward.

That article you're referring to happened twenty-four hours ago - a lifetime in today's world.

20. Yep. Another detail I learned this a.m. The Spanish AG tried to shut
down the case as a favor to Obama per Scott Horton. But, that's a political move and has nothing to do with the law. The actual prosecutor did NOT try to shut down the case and in fact argued that it would be pretty easy to bring. So, it was a double fail for AP.

In a ruling Friday, Garzon ignored this advice but also avoided a direct confrontation with the attorney general's office by submitting the case to a lottery system which will now assign it at random to one of the six high court judges.

"Let it be assigned to the corresponding court," Garzon said in the ruling.

The judge who gets the case will now have to decide whether to go ahead of it. Under the system, Garzon will have a one in six chance of getting the case back.

Unlike in USAmerika where the persecutors hold sway, the Spanish system puts the decision about what, who and when to charge in the hands of the presiding judge.

Allowing persecutors (spelling intentional) to be in charge of the criminal-injustice system makes it certain that injustice will prevail!

In other words, in USAmerika the SYSTEM IS the "crime" problem.

and talk them out of it. Because as I've learned from this site, all that matters is getting Democrats elected. And I'm sure Mr. Hope is against this because it might alienate a voter in Alabama.
