Senate Judiciary Committee Chairman Patrick Leahy has called on Bybee, now a federal appellate judge, to explain his legal reasoning on harsh treatment of detainees.

By Carol J. Williams
May 1, 2009

A federal judge who provided the Bush administration with legal advice on what constitutes torture declined to respond Thursday to a letter from the Senate Judiciary Committee chairman calling on him to explain his actions to the American public.

Judge Jay S. Bybee, of the U.S. 9th Circuit Court of Appeals, was head of the Justice Department's Office of Legal Counsel when he described the intensity of pain that could legally be inflicted.

The interrogation methods, including waterboarding, have been denounced by the Obama administration, human rights groups and foreign allies as illegal torture.

2. I think we should set up a water board device in the Senate hearing room
and have Judge Bybee testify while strapped to it.

5. Yes, but people who know that drowning will not actually occur have an advantage that
detainees in Gitmo did not have.

9. So maybe we should just accidentally drown him.
He's only one person who destroyed America's values... we can live without him.

Just kidding, of course.

3. It's hard to write or type when your hands are shaking so hard you can't hold a pen.
That's how I'd like to picture Bybee right now. Taking the full public brunt for starting us down this horrifying course.

8. This was a cop out for Leahy. The moment he came up with.............
........this hair brained idea of "inviting" Bybee to testify, we all knew that he wouldn't show. AND, Leahy played this bullshit scheme up for his political gain. My opinion of what is going to happen on the torture thing is Bybee will be disbarred and forced to resign, Yoo and Hadley will be disbarred and that will be the end of that. Maybe, just maybe if any more "bombshells" come out there may be further prosecutions, but I seriously doubt it.

10. He has the right to remain silent
Yes, it's time for the Miranda Warning, even though Bybee hasn't been arrested or arraigned.

He knows he's in a heap of trouble.

At least he's got more presence of mind than "Dr." Condi Rice, who basically indicted herself for criminal conspiracy the other day.
