Lawyer petitions Supreme Court about youngest Gitmo detainee

(CNN) -- The youngest detainee at the Guantanamo Bay, Cuba, detention facility is to be tried next week by a military commission -- with a life sentence as one possible outcome -- and now his lawyer has gone to the U.S. Supreme Court to try to stop it.

Omar Khadr was 15 when he was apprehended in southeast Afghanistan in 2002, accused of lobbing a grenade that mortally wounded a U.S. medic. He also is accused of receiving one-on-one training from al Qaeda and being caught on a surveillance video making and planting roadside bombs where U.S. troops traveled.

Now 23, he faces trial at Guantanamo on August 10, on charges of murder and attempted murder in violation of the law of war, conspiracy, providing material support for terrorism and spying.

Khadr, a Canadian citizen who was born in Toronto, also is the only Westerner still held at the Guantanamo facility.

1. He was an overzealous, impressionable 15 yr old when he went in........he's probably


a full-blown terrorist NOW, that's for sure. Why in heaven's name did we put a this young man in Gitmo?

And that about explained it all to me.

It sucks, but its true. Humans love some good torture.

Army lawyer asks Supreme Court to stop Guantánamo trial

WASHINGTON -- The Army lawyer defending the last Western captive at Guantánamo turned to the U.S. Supreme Court Monday in a last-ditch bid to stop the upcoming war crimes trial of alleged Canadian terrorist Omar Khadr.

The Toronto-born Khadr, 23, was captured, critically wounded, at age 15 in Afghanistan in a U.S. raid on a suspected al Qaeda compound.

Pentagon prosecutors charge that Khadr committed war crimes for allegedly hurling a grenade that killed a Special Forces soldier in the July 2002 raid. The Pentagon also accuses Khadr of conspiring with al Qaeda to commit terrorism for allegedly helping to plant bombs along Afghan roadways to resist the U.S. invasion to topple the Taliban and route al Qaeda after the 9/11 attacks.

But Army Lt. Col. Jon Jackson, Khadr's Pentagon-appointed defense lawyer, said in a statement Monday that U.S. plans to put him on trial before a military jury at Guantánamo later this month deny the Canadian due process because the court is designed for foreigners not American citizens.
