Prop. 8 backers anticipating defeat

(08-03) 19:18 PDT SAN FRANCISCO -- A federal court ruling on the right of same-sex couples to marry in California is scheduled to be released Wednesday - and opponents of gay and lesbian nuptials are already making plans to appeal.

Chief U.S. District Judge Vaughn Walker of San Francisco will decide whether Proposition 8, the November 2008 initiative that defined marriage as the union of a man and a woman, violated gays' and lesbians' right of equality under the U.S. Constitution.

After court officials on Tuesday announced plans to release the decision, Prop. 8's sponsors filed papers making it clear they expect to lose this round. They asked Walker, if he rules against them, to leave the ban on same-sex marriages in place while they appeal.

Lawyers for Prop. 8's backers told the judge they were confident that any such ruling would be overturned on appeal. They said a stay would honor the will of the voters and would not harm same-sex couples, who can still register as domestic partners.

2. There's reason to be optimistic about the SCOTUS.
The balance of attitudes hasn't changed substantially since the 2003 Lawrence vs Texas decision that overturned sodomy laws. Kennedy has always been the crucial swing vote.

9. The judge should ban ALL Civil Marriages and make EVERYONE register as Domestic Partners.
Since it is, after all, good enough for gay people, right?

10. And domestic partnership is only recognized by a state....
so when the hetro couple cross over a state line, they no longer have partnership rights. Maybe then they would understand.

I believe that there will be equality in the end. Too bad there are so many haters blocking the progress. It may have been slowed down, but it is still progressing. Do Not stop the fight. When I was in high school, my best friend in school came out to me saying she was a lesbian. I did not understand it at the time...but I soon understood that she had no choice about her sexual orientation, as did I as being hetro.
