Orly Taitz Appealing Supreme Court Smack Down Of Birther Case

Birther queen Orly Taitz isn't backing down in her fight against being forced to pay a $20,000 fine slapped down by a federal judge last year for filing "frivolous" litigation aiming to challenge President Obama's citizenship.

Taitz has filed a "motion for reconsideration" with the court, according to documents posted on her web site, claiming that she has new evidence that President Obama is not an American citizen.

32. Lawyer discipline
The State Bar is the only bar association that operates a State Bar Court, equipped with judges who specialize in handling professional responsibility cases. Under the State Bar Act, upon receiving a complaint, the Bar may choose whether to open an investigation. If the Bar does find sufficient evidence of misconduct, decides that it has standing, and decides to take action to impose discipline, it has the power to proceed against accused attorneys either in the Supreme Court of California or in the State Bar Court. The State Bar holds that it may decline to review complaints that are not made by a Judge who heard a matter related to the complaint. Complaints of professional misconduct are usually first prosecuted in the Hearing Department of the State Bar Court. If the lawyer disagrees with an adverse decision, he or she may appeal to the Review Department of the State Bar Court, and from there to the state supreme court.

This is the magic paragraph:

"The State Bar holds that it may decline to review complaints that are not made by a Judge who heard a matter related to the complaint."

Has the federal judge who fined her filed a complaint?

10. I read the 13 page 'motion' earlier on HuffPo - unbelievable
First of all I can't believe she didn't spell check her motion for errors - you just don't submit something that sloppy to the SCOTUS.
On the first page 'RECONSIFERATION' -- misspelled with a 'F' sticks out like a sore thumb!
And her inclusion of the WH's release of the 'Obama passport video' as evidence is laughable!

"Counsel, we've reconsidered and find that, indeed, the $20,000 fine imposed in the lower court was inappropriate. After further consideration, as you requested, we are increasing the fine to $50,000. Further, we're giving you the alternative of avoiding the fine entirely by surrendering your right to practice law in any court, state or federal, in the United States.

So say we all."

1) Deny the appeal again
2) Sanction her $2 million, and place a lien on all of her and her husband´s holdings
3) Expedite her disbarment proceedings, as well as her revocation of her dental license and her real estate license
4) Revoke her citizenship, and have her deported her back to Moldova, permanently, since she produces nothing for the United States.

I don't agree with the Judge saying she needs to pay $20,000 because it was a 'frivolous' case.

If anyone has the money to pay for court fees and a lawyer, I think they are entitled to take anything to court.

It's creating jobs and giving the courts revenue. I don't think this judge realizes who or how Judges get paid or
how the courthouse lights stay on.

Every American should be able to access our courts, if they have money to throw away...who cares.

If I was the Judge I'd have let the case last 30 minutes and collected my $$$$ from her and sent her on her way.

Once a case or cause of action has been decided, it's up to the court to clear its calendar of useless and frivolous stuff, and they do that in concert with attorneys, who are also officers of the court. Suppose you had a real cause of action based on a real tort or contract breach or something, but you couldn't schedule court time because every judge was occupied dealing with frivolous Orly Taitz motions. At some point, the court has to say "no" and have it stick. The sanctions provided by Rule 11 are rarely applied, but once someone has earned that sanction, they should be on the hook.

And yes, judges are very aware of how they get paid and how the courthouse lights stay on, and it isn't through indulging the pettifogging antics of dimwit attorneys who don't know the law.
