Alan Keyes Ordered to Pay President Obama's Court Costs

A state appellate court in Sacramento threw out a lawsuit claiming President Barack Obama is not eligible to occupy the White House because he is not a natural-born citizen of the United States. The court ordered the plaintiffs to pay all court fees of the defendents.

The lawsuit was filed shortly after the 2008 general election. The leading plaintiff (of three) was Alan Keyes, a former member of President Ronald Reagan's administration from Maryland, and the 2008 American Independent Party candidate for president.

Keyes is a member of the so-called "birthers" movement. In his complaint, he claimed there is persuasive evidence Obama was born in what is now Kenya, which was then (1961) the British East African Protectorate of Zanzibar. He further claimed that President Obama would have automatically been a British citizen, based on his father's citizenship, and ineligible for office.

The judgment is affirmed. Plaintiffs shall reimburse defendants for their costs on appeal. (Cal. Rules of Court, rule 8.278(a)(1).)

The three sued Obama, Vice President Joe Biden, California’s 55 presidential electors from 2008 and Secretary of State Debra Bowen days after Obama’s election in November 2008. They sought to bar Bowen from certifying the names of the electors until Obama produced documentary proof that he was qualified to serve as president, and to impose a similar requirement in future elections.

Court cost are the fees paid to the COURT, not the fees paid to attorneys. I do NOT know what fees the Defendants (Obame et al) had to pay but I suspect nothing since they are the DEFENDANTS and it is the PLAINTIFFs who pay any filing fees.

Yet, US Customs has no record of her re-entry into the US from Africa.

Why is that? Probably because Obama's mother HAS NEVER BEEN TO AFRICA. In fact, from January 1961 to December 1961, she never even left Hawaii, since all student and work records show her being in Hawaii nearly that entire year. Obama was born in August 1961.

So, how could Obama have been born in Kenya when his mother's never been to that continent, and she never left Hawaii for nearly all of 1961? I don't think medical technology has advanced to the point where a baby can be born in one place and his/her mother be in another place.

"He's a citizen because Hawaii says so".

One of the whole points of the federal system is that some activities are delegated to the states. Such as birth and death records. Hawaii says he was born there. They're the ultimate arbiters of who is born in Hawaii.

Now, if these damn 10thers would be remotely consistent in their beliefs, there would be no birthers. But we all know how consistent the crazies are.

Being an airplane (and all things associated) nut, I can't remember how often I've told some Birther just how difficult it would be to get from Hawaii to Kenya in 1961. Just the tickets alone cost more than the annual income of the average american, so how the hell could two students afford it? And then of course there's the fact that in order to go to Kenya in the first place, Stanley Ann would have had to have vaccines - at least one of which (I forget which one) simply wasn't given to pregant women.

I did some looking up and I think it's the MMR vaccine that can't be given to pregnant women. That's the combo "mumps-measles-rubella" vaccine.

More specifically, it's the "measles" part of the vaccine that is problematic for pregnant women. So a vaccine that is measles only is also not allowed for pregnant women.

The rules in place in 1961 stated, that if only one of the parents was a US citizen, he or she would have had to have resided in the US for at least 5 years after his/her 14th birthday. Stanley Ann Dunham hadn't turned 19 yet, so technically she couldn't pass US citizenship.

Of course, the point is moot since Obama was born in Hawaii, but it has given rise to some interesting legal discussions.

Us evil lawyer types use "costs" and "fees" to refer to two different things.

"Costs" are the filing and whatever procedural fees there are. "Fees" are what gets paid to the lawyers.

Not a military base. You may have his circumstances confused with McCain's. His birth certificate is the same as issued to every Hawaii citizen who requests it from the Office of Vital Statistics.
