Chertoff sues the University of Texas in Brownsville (UTB) (PDF) and Texas Southmost College (TSC), a classic case of American democracy vs. American dictatorship.
What kind of government lies and threatens, lies and bullies, lies and abuses its power, then lies and terrorizes its citizens? What kind of government systematically sues model citizens? What kind of government will use any form of force to intimidate and frighten those faithfully serving their community and their country? What kind of government would willfully commit illegal and unconstitutional acts to terrorize citizens on the pretext of national security?
A look at the South Texas gives a clear and chilling answer. American democracy is being assaulted by America tyranny. An unlawful tyranny wielded by Secretary of the Department of Homeland Security, Michael Chertoff.
The UTB President, Juliet Garcia, posted her reasons for not bowing to the dictates of Chertoff on the
UTB website. There she delineated five reasons for not allowing a border wall to cut across the UTB campus:
- It would cut through the “very heart of the campus”.
- It “would jeopardize the campus security.
- It would be counter to the mission of community and heritage.
- It would violate the ecology and environment.
- It would desecrate famous historical sites, including Fort Brown and Fort Texas, which would end up on the “Mexican side” of the wall.

When Peter Schey of the Center for Human Rights and Constitutional Law sued Chertoff this week in behalf of property owner,
Eloisa Tamez, the lawsuit clearly states that
the United States and Chertoff "have acted in flagrant disregard for the laws of the United States," that their actions are "in violation of federal laws" and that "Chertoff does not have the authority" to utilize the procedures that he is employing to overpower common citizens.
If that is true, Chertoff indeed is committing "illegal" acts outside the parameters of Constitutional law. He is therefore the most reprehensible "illegal" in the country, simply because he is doing this in the name of the United States of America. He is “flagrantly” operating "outside" the law of the United States of America, so is therefore an “outlaw” of the worst kind. What would we do with a corrupt sheriff or a corrupt general?
As we watch this chapter unfold in the writing of American history books, we won’t have to wait long to see what kind of America emerges, an American democracy or an American dictatorship.
