New, stupid, badly drawn and questionable Chick Tract up!
"Here Kitty Kitty"

The heartwarming story of a little girl whose brother (who is a witch) is going to sacrifice her kitten so he can cast a spell on her Jesus-freak teacher. Who, of course, recruits the little girl for Jesus.

Bad art.
Bad story.
Possibly illegal proselytizing on school property.

I give it thirty-six stars--the number you'll see after conking yourself in the head with a coal shovel after reading this.

God was like sooo pissed about that time he was glaring at that girl's booty from around an alleyway and the guy like totally went to hell for that alone! Damn but he was remorseful---once he was caught by God for doing that shit. Hey, too late, sucker! Now you're gonna burn in Hell!! Double-ha!!

Yep, Jack's past his prime. But let's try and remember Jack as he was--that little student in the Big Liberal University class who could always make his Evolutionist professor sputter with a calm recitation of the Truth those Darwinists don't want you to know...

32. It's not fair use if he's making money from it.
You generally can't make money off of somebody else's intellectual property, though exceptions exist for parody and certain other things, and an artistic style qualifies as intellectual property.

Courts give pretty wide latitude for parody. The second Chick lawyer calls this making fun of mainstream social mores regarding Halloween as represented by old popular Peanut cartoons, the case is over. There's not an honest lawyer in the country who would try to sue Chick on these grounds. They'd be laughed out of court.

Sorry, but "and Justice for All" includes fundy assholes, too.

36. Other than the look, nothing in it suggests parody
If the boys were sacrificing the cat to the Great Pumpkin, or the teacher made the wa wa wa noise when she talked, they'd have a case for parody. If anything in Chick's back catalog was parody (the closest I can think of is filing the serial numbers off of D&D in "Dark Dungeons" and that doesn't qualify because the tract is a straightforward screed about the evils of role playing games, just with the name changed so nobody'd sue) they could make that case. As is, I don't think a reasonable person could conclude that this tract is a parody of Schultz's work or anything else.

You don't get to decide what others can and can't parody, I don't get to decide what others can and can't parody, and the courts don't get to decide what others can and can't parody, nor how they get to express their parody. If he was marketing this art work as Peanuts or there was some other similar attempt to confuse readers, then yes--that's trademark infringement. That is demonstrably not the case. You can't sue someone for making bad art work, only for fraudulent use.

I'm having a little trouble understanding why I have to even argue this point on a liberal website.

and artistic style is protected intellectual property.

It doesn't have a damn thing to do with not liking Jack Chick, if it was I'd be objecting to some tract that was more offensive and less trite. It's just that he's using another artist's style (and it pains me to call Chick and artist, but the merits of his work aren't relevant to the argument) for commercial gain, he's being exceedingly obvious about it, and that's not good ground to be standing on legally.

This is a drawing from one of his more recent tracts, the black version of "This Was Your Life":



Most of the panels in this tract look real good.

Also, this panel from the black version of "Who Is Allah?":



Of course, the Islamic gentleman failed to point out the other simple truth about American Islam: in addition to being the second-largest, and the fastest-growing, religion in America, most if not all of its converts are African-Americans. (Converts are different from Practitioners. Many Arabic men are Muslims, but they grew up in the faith. Converts usually started out in the Missionary Baptist Church or the Church of God in Christ.) I've never seen a Muslim skullcap being worn by a Caucasian, Hispanic or Native American man, but I see a LOT of them on African-American men.

Chick's dropping some good-looking tracts these days, with plenty of shading and attractive linework. Jack Chick is still crazy as a shithouse rat and his product reflects that, but the art's far better than it was in the era of "Trust Me" or "The Trial."

My favorite part in all these Chick Tracts is the line Jesus uses when he sends someone to Hell. "Depart from me, ye cursed, into everlasting fire, prepared for the devil and his angels." It's my favorite part because it's part of the passage about the sheep and the goats:

When the Son of Man comes in his glory, and all the angels with him, he will sit on his throne in heavenly glory. All the nations will be gathered before him, and he will separate the people one from another as a shepherd separates the sheep from the goats. He will put the sheep on his right and the goats on his left.

Then the King will say to those on his right, 'Come, you who are blessed by my Father; take your inheritance, the kingdom prepared for you since the creation of the world. For I was hungry and you gave me something to eat, I was thirsty and you gave me something to drink, I was a stranger and you invited me in, I needed clothes and you clothed me, I was sick and you looked after me, I was in prison and you came to visit me.'

Then the righteous will answer him, 'Lord, when did we see you hungry and feed you, or thirsty and give you something to drink? When did we see you a stranger and invite you in, or needing clothes and clothe you? When did we see you sick or in prison and go to visit you?'

The King will reply, 'I tell you the truth, whatever you did for one of the least of these brothers of mine, you did for me.'

Then he will say to those on his left, 'Depart from me, you who are cursed, into the eternal fire prepared for the devil and his angels. For I was hungry and you gave me nothing to eat, I was thirsty and you gave me nothing to drink, I was a stranger and you did not invite me in, I needed clothes and you did not clothe me, I was sick and in prison and you did not look after me.


This passage flies in the face of Chick Theology because it DEMANDS works, and Chick Theology routinely sends people to hell for works.

Chick Theology also sends people to hell for beliefs outside the Bible, but he subscribes to Rapture Theology and that's not in the Bible.

Basically, do as I say, not as I do...

But of course the fundies don't believe in "works", only belief. That way they don't have to actually do anything for anybody but themselves while they scream about what everybody else is doing "wrong". It makes things mighty convenient for them.
