A Time Limit on Rape???

The accuser and the defendant agree that after he began to penetrate her and she wanted him to stop, he did so within a matter of seconds and did not climax. Even so, during deliberations, the jury sent a note to the judge asking if it was rape if a female changed her mind during the sex to which she consented and the man continued until climax. The judge said it was for them to decide. They convicted the defendant of first-degree rape, among other sex offenses.

1. What that article doesn't tell you
Is that this was in the back seat of a car, her and two guys who held her down and coerced her into concenting. It was rape, no doubt about it. This issue of her giving or withdrawing consent is a total distraction.

The sequence of events was:

1. They begin to have consensual sex.
2. She says no.
3. He withdraws in a few seconds.

??

If this is the correct sequence of events, then I would say no, that is not rape.

I would say he respected her wishes.

In all fairness, if I were in that situation, having sex that I believed both of us wanted and then heard "no," it probably would take a few seconds (at a moment like that) to fully realized that she means "stop, I no longer want to do this." At that point, obviously the only correct thing to do is stop, but it realistically could take a few seconds to understand what's going on.

9. Exactly.
I've been in...ahem..compromised positions where I'll say "Wait, stop!" because the SO is laying on my hair or I have a cramp in my leg. I imagine it would take a few seconds for any guy to translate, "No" as "Stop having sex with me." A few seconds seems reasonable.

You may want to check your facts. For one thing I rarely post in GD, and for another I have never made such an accusation. Your "memory" needs a little work.
