Poll question: Is Antonin Scalia a human being? Or is he a monster.

This is not a debate about the death penalty, but whether or not the state has an obligation to use a less painful method. I post this in the lounge mostly to avoid having a tangential death penalty argument.

here is what scalia had to say about it:

But where is it written that the state must choose “the least painful method,” Justice Scalia demanded. “Is that somewhere in the Constitution?

i was fairly appalled hearing this today. it seems so inhumane.


"Justice Antonin Scalia noted that execution methods that have fallen out of use — the electric chair, the firing squad, the hangman’s noose — have been abandoned in part because of fears that they were not pain-free"

1. Human. A really evil human.
Monsters can't help being monsters; Godzilla stomped Tokyo because he was a monster and that's what they do. But humans have free will and they don't have to be evil. Scalia has chosen to be an evil fuck, and that's a whole lot worse.

I'd rather have Mothra on the Supreme Court, or even Cthulhu.

5. Isn't there a prohibition on cruel and unusual punishment?
Being categorically opposed to the death penalty, I consider any method to be cruel. But lethal injection may be better than some. I've heard of electrocution taking an inordinately long time, for example. I can't imagine having to be a witness to any execution.

But Scalia is a monster for that statement and for everything else.
