Ely said he feels sorry for the family’s loss but, as a fellow dog owner, feels strongly that they must be responsible for their pets’ actions. He spent more than $600 putting a fence in his backyard to keep his dogs contained.

“I have complete compassion for them,” Ely said. “I know how it feels. I love dogs. But once you get them, they are your responsibility.”

The Munthes have filed a $2,400 countersuit against Ely for the cost to buy Fester, the time they had to take off work for court appearances and the cost of buying a dog to replace Fester.


This reminds me of the idiots who drive down the highway with their dogs just hanging out in the open pickup truck bed who would then probably sue anyone whose car the dog lands on when it jumps or gets jostled out of the truck.


I do wonder, though, why Ely's insurance didn't pay for the damage? I can only assume that he doesn't have insurance. Which makes him also a dick. Looks like this is in Minnesota - isn't Minnesota a mandatory car insurance state?

Sometimes killing a dog is heroic, sometimes not.

I'm not sure why you would ask this question here, since the discussion at hand has nothing to do with linking "heroism" with "killing a dog".

Perhaps you thought you were in a different thread?

seems like you're calling the guy a hero to me. I think he sounds more like a heartless bastard than a "hero saint"

3. Liability insurance doesn't cover collisions
He may have had liability insurance, which would cover any at-fault accidents he caused, but those policies don't cover damage to vehicles caused by hitting things. In this case, a dog would be seen as a thing by an insurance company, so they would not fix his car. Carrying comprehensive/collision insurance on an 11-year old car generally doesn't make much sense, unless the car is in exceptionally good shape; is an unusual/rare car, etc. The repair costs for this accident are probably less than 12 months' premium for full coverage insurance on a car that old with such high repair costs.

7. Wait a damned minute.
They sued for both the cost of the dog he hit and the dog they got to replace him? He didn't kill two dogs. Either they get "replacement cost" or value of the dog, depending on local precedents, but they don't get both. He's an asshat, but clearly the dog's people are also asshats.

8. MN requires liability insurance
The car was older-he probably didn't have full coverage. That's a traditionally poorer part of the state as well. If the car was seriously damaged, he may not have had the money to fix it.
