My BIL's son was incarcerated last weekend
I won't way "arrested" because he wasn't- he'd walked from a bar in a notorious Texas town (I won't say which town) and was walking to the store for some cigs. Two cops jumped from their car, cuffed him, and took him to jail. At the lockup, as he asked what he was being charged with, six cops surrounded him, stripped him naked, and tazed him. They then denied him water for a period of 36 hours. He was finally fined and released.

The charge? Public Intoxication. He'd had 2 beers while at the bar and was nowhere near a vehicle.

He's just 22 years old.

No moral to the story, no happy ending, no further comments from me other than to say I'm just- sad.

1. More like, welcome to Texas.
Not all Texas towns are like this one, but there is definitely an "attitude" there that I frankly don't care for.

I hope this kid is okay.

What an ordeal!

BTW, are they thinking about suing?

2. No, they're not gonna do anything, and I don't blame 'em.

4. Justice has nothing to do with the Texas legal system.
I should know- I was on jury duty on Monday. The poor sap on the case I was almost on never had a chance, and everyone in the room knew it as soon as he started talking (he was a gypsy biker who was determined to defend himself against a six year old aggravated assault charge after going through 5 lawyers. Need I say more?).

18. Awful. What part of Texas? Glad he walked away. In my family,
we have discussed what to do in case we get pulled over...

Keep your hands where they can be seen.

Do not get out of the car unless instructed.

No sudden moves.

Have DL and insurance certificate handy.

DO NOT SIGN ANYTHING other than receipt of ticket/promise to appear form.

Listen closely to officer and answer questions if you feel comfortable doing so. BUT THERE IS NO OBLIGATION TO TALK TO A COP WHATSOEVER. IF YOU FEEL UNCOMFORTABLE OR MIGHT INCRIMINATE YOURSELF... SHUT UP. Just politely decline. The cop is NOT THERE TO HELP YOU.

(just thought I'd share all of this!)

Many arrestees often sign confessions out of fear and because they just want to go home quickly only to pay for it bigtime later.

There are good cops out there. Lots of them. But not all of them.

22. In all honesty, we only know that side of the story.
And if that is all true, then no they didn't have his best interest at heart. But why they would sit back and take no action is beyond me.

ON EDIT.. just reread my post and saw that I said "the cop" is not there to help you. (the hypothetical cop during that hypothetical stop). I was obviously referring to "that cop" and not all cops... so your "bashing" claim is unfair.


The purpose of my post was to remind people that the correct behavior during a stop can minimize the personal setbacks that could arise from such a situation and also make things safer for the officer. And yes. they are well within their rights not to talk to a cop.
