It's time for your Constitutional Law Exam
or rather, some of the things I "learned" while grading some this evening. I will let you in on these closely held secrets of Constitutional Law ... in no particular order:

The first African American Supreme Court Justice was Clarence Thomas, says one, but another says that it was Condaleza Rice.

Did you know that John Marshall was appointed Chief Justice by President "Ragan"?

In Marbury v Madison, Marbury was seeking a writ of "juriditor"

Missouri v Holland was "the bird case"



Just a few things for you to think about as you toddle off to bed.

3. Row v. Wade was a dispute over crossing a stream
Loving versus Virginia was about a personal choice (would she get some Loving or remain a Virginia all her life?)

crew.

6. Today I am reading essays on Missouri v. Holland

9. Oh how I wish ashy. I have always been a regular j.d. but I
most unfortunately became an official jd or j.d. or J. D. in December, 1977.
I never reveal that, tho', as it causes nothing positive in response. Only unreasonable expectations, or outright bigotry and ignorance, which I know is common, but embarassing to see, nonetheless.
The most important factor ... a sense of humor.

10. I graded 200 1L papers today...
I learned similar things, like:

1. State courts in California are not bound by US Supreme Court decisions because state law and federal law are completely separate things.
2. California Supreme Court decisions are binding on lower courts in New York.
3. Decisions from the 2nd Circuit Court of Appeals are secondary sources of law, not primary.
4. The US Supreme Court can never overturn its own decisions. In which case, I guess Plessy v. Ferguson is still good law...
