Calendar of Public Hearings/Comment Periods re: Voting machines

I will do my very best to keep this updated but any info. other DU'ers find will be much appreciated.

Meeting dates, times and places will be listed for each state as I can find/update it. Here goes - bear with me if it's a bit of a mess to start with...


CALIFORNIA

Public hearings re: voting machines have already been held (only 4 or 5 in the entire state..) but it is NOT too late to submit comments.


Please submit your comments regarding the Preliminary California State Plan by July 17, 2003, so they may be considered prior to the publication of the Final State Plan. Comments may be submitted in writing by mail, hand delivery, fax, or e-mail.

1. PENNSYLVANIA Public Hearings
One public hearing will be held in Reading on Monday, July 7, 2003 in City Council Chambers, 815 Washington St. from 6 – 8 p.m.

One public hearing will be held in Pittsburgh on Wednesday, July 9, 2003 at the William Pitt Student Union, Kurtzman Room, on the University of Pittsburgh Campus from 6 – 8 p.m.

One public hearing will be held in Philadelphia on Monday, July 14, 2003 at The Kiva Auditorium, Ritter Hall Annex, Temple University, from 6 – 8 p.m.

Anyone wishing to testify should contact:

Barbara Smotherman of the Pennsylvania Department of State at bsmotherma@state.pa.us or (717) 787-6458.

The Secretary of the Commonwealth encourages those testifying to submit a written copy of their testimony, in advance, to Barbara Smotherman at bsmotherma@state.pa.us or at the Pennsylvania Department of State, 302 North Office Building, Harrisburg, PA 17120.

All who testify must bring fifty (50) printed copies of their testimony to the hearing. Anyone testifying is strongly encouraged to briefly summarize their testimony and to be prepared to respond to questions. Individuals testifying on their own behalf will be allocated five (5) minutes and individuals testifying on behalf of groups will be allocated a total of ten (10) minutes in which to make their presentation.

If you are a person with a disability who wishes to attend any of the hearings, and you require an auxiliary aid, service or other accommodation to participate in the proceedings, please contact: Barbara Smotherman at the telephone number, e-mail or address above. Text telephone users may contact the Department of State via the PA Relay Center.

3. NEBRASKA public comments due by July 10th..

According to a press release dated June 10th, 2003 there was a public comment period of 30 days to make your views known. There are only 2 DAYS left!

The public hearing was on June 25, 2003 in Room 1507 of the State Capitol at 9:00 A.M.

The State Plan will be open for written comments by the public for the next 30 days. After a review of any submitted comments, the State Plan will be published in the Federal register for 45 days. A copy of the Plan may be obtained by contacting Secretary of State Gale’s office at Suite 2300, State Capitol, Lincoln, NE 68502 or by calling 402/471-3229.

However, Secretary Gale encouraged those with comments to write with their suggestions. “I welcome and encourage everyone’s input, not only during the 30 day comment period mandated by the Act, but at any time as this plan is developed,” said Gale.

The Plan and other Help America Vote Act materials are also available on the Secretary of State’s website at http://www.sos.state.ne.us/Elections/HAVA/HAVAmenu.htm .

NOTICE OF PUBLIC POSTING AND HEARING

Secretary of State Matthew A. Brown has drafted the Rhode Island State Plan required under Section 253 of the Help America Vote Act of 2002 (HAVA). The State Plan will be posted for a 30-day period so that members of the public can review and submit comments prior to its submission to the Federal Election Assistance Commission.

After the 30-day review period, the Secretary of State will submit the HAVA Rhode Island State Plan to the Federal Election Assistance Commission for posting in the Federal Register for a 45-day period as mandated under HAVA.


Copies of the HAVA Rhode Island State Plan are available for public inspection in the Office of Civic Participation and Public Information, Room 38 of the Rhode Island State House, Providence, Rhode Island. A copy of the plan is also available online at www.state.ri.us/hava/final-HAVA.pdf

6. KANSAS - written comments until July 14th
Written comments from the public will be accepted from June 12 to July 14.

Written comments must be made to Mindy Miller, Legal Associate, Office of the Secretary of State, Memorial Hall, Room 130, 120 S.W. 10th Avenue, Topeka, KS 66612-1594, (785) 296-0080.

STATE PLAN

The Help America Vote Act of 2002 (HAVA) requires each state to develop a state plan describing how it will implement HAVA. The plan will be developed with assistance from the Kansas Election Reform Advisory Group and must be filed annually with the Election Assistance Commission (EAC). HAVA requires a public hearing to be held regarding the state plan at least 30 days before the plan is filed with the EAC. The Secretary of State’s office plans to file the state plan in late July or early August.

8. MICHIGAN - public comment ends JULY 17, 2003
Michigan’s Preliminary State Plan was released for public comment on June 17, 2003 and can be accessed below. The public comment period will end on July 17, 2003.


If you choose to comment, clearly identify the sections of the plan you are commenting on by page number.

Comments may be e-mailed to the department at HAVAplan@michigan.gov.

Comments sent by U.S. mail should be addressed to the Michigan Department of State, Bureau of Elections, Attn: HAVA Plan, P.O. Box 20126, Lansing, Michigan 48910-0726.


After the public comment period has ended, the State Plan will be revised as necessary and submitted to Washington, D.C. for publication in the Federal Register for a 45-day period. Michigan’s State Plan is anticipated to be submitted on July 21, 2003. Michigan may be eligible to receive federal funds as early as July 28, 2003.

Public hearings to receive comments on this state plan will be conducted on July 15, 2003 in the Board’s principal office located at 1020 S. Spring Street, Springfield, Illinois at 1:30 PM, and July 16, 2003 at the Renaissance Chicago Hotel, 1 West Wacker Drive, Dearborn Room, 4th Floor, Chicago at 1:30 p.m.

The hearing is open to the public and all interested persons will be given the opportunity to present testimony. Testimony will be limited to ten (10) minutes per person. To ensure that all comments are accurately recorded, oral comments presented at the hearing must also be provided in written form. Written comments can also be mailed to the staff contact listed below.

Any person requiring special assistance should contact the staff contact below at least one week prior to each hearing for appropriate accommodations.

Written comments regarding the proposed draft of the Illinois State Plan will be accepted from July 1, 2003 through July 31, 2003.

The 30 day comment period ended June 30, 2003. We haven't scheduled any further public hearings. However, that doesn't prohibit us from taking further public comment into consideration. 22. ARKANSAS- final hearing JULY 10, 2003

There will be a final HAVA meeting July 10, 2003 at the Arkansas State Capitol. The meeting will be in the Old Supreme Court room at 10:00 a.m.

I suggest calling to see if they require submitted written testimony
prior to the hearing.

New Mexico's State Plan for Compliance with the "Help America Vote Act" will be available for public comment from June 23, 2003 through July 23, 2003.

Copies of the plan may be requested from the Office of the Secretary of State by calling 1-800-477-3632. Copies are also available from your county clerk. (or online with Adobe)

Written Comments should be submitted to: Office of the Secretary of State, 325 Don Gaspar, Suite 300, Santa Fe, NM 87503.

28. OHIO - public comment period ended June 13, 2003

In accordance with the Help America Vote Act (HAVA) of 2002, the Ohio Secretary of State provided a copy of the Ohio's Preliminary State Plan to the citizens of Ohio for a 30-day public comment period. The public comment period began on Tuesday, May 13, 2003 and ended on Friday, June 13, 2003.

After final review and approval of the state plan by the Secretary of State the plan will be sent to the Election Assistance Commission who will publish it in the Federal Register.

29. SOUTH DAKOTA - deadline was July 7, 2003
South Dakota is beginning the process of complying with the new requirements of the Help America Vote Act. A task force has been developed to write a "state plan" or roadmap of how our state will comply with the Act's requirements and what improvements can be made to our election system.

The task force met on March 19 and May 14 to discuss what should be included in South Dakota's state plan. The task force has created a public comment draft of our HAVA state plan. The public comment plan document is available and comments can be made on that document until July 7, 2003. All comments should be sent to the Secretary of State.

53. Washington residents take note
The WA HAVA implementation plan can be downloaded from the secretary of state's web site. It is available in PDF or HTML.

For Seattle residents: I will be going to the hearing in Olympia tomorrow. I will have room for a couple of riders if anyone wants to share space.

If anyone at all wishes to discuss the issues before or after the hearing with a fellow DU person, send me a private email on DU. I have never used that, but I will check for messages later today.

The public comment period ran from June 2 through July 2. The Plan will appear in the Federal Register for 45 days however, this period will be administered by the Election Assistance Commission, an entity that has not yet been appointed. I don't know when it will appear in the Federal Register, just that it must.

The Missouri public comment period for the HAVA state plan will end on Wednesday July 9th. Afterwards, the plan will be published in the Federal Register for a 45 day comment period. Comments should be submitted to the Elections Division of the Secretary of State's office at this email address, or at (573) 751-2301.

Formal procedure for the hearings:

The formal procedure will mirror administrative hearings:
There will be an official opening statement and the floor will be open for persons to testify; persons will be required to sign in, requested to submit their comments in writing (not required), and allowed to speak no longer than 10 minutes (depending on the number of persons signed in for testimony).


How and where should public comments be submitted:

Public comment can be submitted in writing to the Secretary of State or my office, can be submitted on-line at www.discovernd.com/hava, under the heading “Proposed Plan,” or at the public hearings held in Minot, Fargo, Grand Forks and Bismarck.

There are three public hearings scheduled for July 24th in West Springfield, Massachusetts.

The hearing of the Provisional Voting and Voter Identification Sub-committee will be held at 11:00 a.m.
The Sub-committee will hear and receive public comment on the HAVA requirements of the availability of provisional ballots and presentation of identification by voters.

The hearing of the Training and Education Sub-committee will be held at 12:00 p.m. The Sub-committee will hear and receive public comment on the HAVA requirements of poll worker training and voter education.

The hearing of the Voting Equipment and Accessibility Sub-Committee will be held at 1:00 p.m.
The Sub-committee will hear and receive public comment on the HAVA requirements that each polling place be accessible, and that by 2006, each location have at least one accessible voting machine. There will also be a demonstration on voting equipment at 2:00 p.m.


Please feel free to attend the above listed hearings and demonstration or provide written comments. For those who require accommodations, please request such accommodations no later than 5 business days before the hearing.

55. MASSACHUSETTS - update
Election Commission Executive Secretary Peter Karg has announced the following community demonstrations of the Accu-Vote Optic Scan Voting System, which will replace Newton's lever voting machines:

Aug. 25: Druker Auditorium, Newton Free Library, 7 p.m.;
Aug. 28, Newton Senior Center, 345 Walnut St., noon.

In addition, NEWTV will be taping a demonstration that will air during the summer. The new system will be in use for the City Preliminary Election scheduled for Sept. 16. For further information, contact the Newton Election Commission at (617) 796-1350.

The public meetings that we did all over the state are concluded. We are having a meeting of our state plan advisory comm. this Friday at 1:00 at the Woolfolk Office Building in Jackson.

The draft state plan is on our web site and you can read it and send us comments by e-mail on each page of the plan as it is posted on our site. The comment time for the draft plan expires on July 28. I encourage you to read it there and send us any comments you may have.

We will send the State Plan to the Federal Register this month after making minor corrections based on public comments and the HAVA advisory committee's suggestions.

States not yet listed: Alaska, Hawaii, Kentucky, Minnesota, Nevada, N. Hampshire, N and S Carolina, Oregon, Texas and Utah..

I have tried to ensure that the information that has been presented is as accurate as possible yet nothing's perfect..

Please take the time to call prior to meetings just in case there are specific methods for submitting comments in writing, numbers of copies, in order to get directions, etc., etc.,

(Don't let these procedures put you off! )

43. OREGON - deadline long gone..
We held 7 public hearings throughout Oregon in April on our draft plan. We also had a 30 day public comment period on which people could provide comments over the internet.

The public comment was considered by our Steering Committee last month and the committee adopted the plan as final with a few changes.

I believe the public hearings were held in May. I was not able to attend but I sent comments anyway to the State BoE. I may be wrong but I think the time for comment has expired. Though that would not stop me from giving them a piece of my mind if I hadn't yet! :)

There are no more scheduled HAVA meetings and the period for public comment has ended. The plan was due on July 1, so it has already been submitted. However, the plan does have room for revision, so if you would like to submit some comments to be considered at a later date, please feel free to do so.

The last HAVA State Plan Advisory Committee was held on June 27th. We will be posting the minutes of that meeting as soon as they are complete. There is still time to comment on the second draft of the plan. Our timeline is finalize the plan next week based on comments and the discussion at the June 27th meeting. We will publish it in the Texas Register and on our website for 30 days and then hopefully send it up to Washington, assuming there is an EAC board appointed by then. Our State Plan Committee met twice via statewide teleconference March 26, 2003 and April 10, 2003.

Our Plan was available for public comment April 28th through May 28th, 2003.

and a statewide teleconference for public comment was May 23rd.

63. Update - Public Comment Deadline - August 1, 2003
If you live in California, you have a chance to make a more immediate difference. Shelley is taking public comments on the task force report, and the overall issue, until Aug. 1.

You can snail-mail comments to Secretary of State Kevin Shelley, attn: Touch Screen Report, 1500 11th St., Sacramento, CA 95814. E-mail comments to taskforcecomments@ss.ca.gov or send a fax to (916) 653-9675.
