Del. couple continues fight for tougher gun laws

"Congress for too long has ignored the 30,000 Americans killed and another 70,000 injured by gun violence every year. Now is the time for action... It's the right thing to do for our nation and for the way too many families and communities that suffer from gun violence," said Paul Helmke, President of the Brady Campaign to Prevent Gun Violence.

In an interview with Sarah Brady last week, she said the Brady Law needs some "revamping."

Changes to the Brady Law that Sarah Brady would like to see include:
A three-day waiting period before being able to purchase a gun, to ensure a thorough mental and criminal background check.
Background checks on secondary sales, e.g. guns purchased at gun shows or from private sellers.
Renew the ban on large capacity magazine assault weapons.

House Democrats say Congress needs to address what they describe as "specific weaknesses" with the nation's gun laws that allow shootings like the one in Tucson to happen in the first place.

1. Renew what ban on large cap mags?
I remember the "ban years"... you could buy all sorts of hicap mags before, during, and after the "ban".

I think alot of gun buyers agree with background checks and wish they could acess the NICS background check system when selling their own guns to srangers. If I recall correctly, the NRA even supported the original bill that created the NICS background check system.

The validity of an "assault weapon" isn't even worth addressing.

2. We tried the 3 day waiting period.. it didn't do shit.
From 1994-1998, there was a three day waiting period for handgun sales. It didn't affect handgun use in crime.

4. Crime stats didn't drop any more precipitously during those years..
nor did handgun use in crime drop any differently before or after.

Either the individual in question is listed in the database as prohibited, in which case NICS will deny the purchase, or he's not. In cases of doubt (where the applicant resembles, but does not exactly match, an individual listed), NICS can order a three-day hold while further checks are conducted.

A three-day waiting period wouldn't have stopped Cho, or Loughner, because they weren't in the federal system, and in Cho's case, it's unlikely that he would have been three days later, so the sales would have gone through anyway.

I'm all for tightening up NICS to raise the likelihood that a prohibited person will be in the database, but I notice that the Brady Campaign, curiously, isn't interested in doing that. They just seem to want to multiply the red tape.
