Oregon appeals court throws out university gun ban

"A state appeals court has ruled that the Oregon University System cannot ban guns on college campuses.

A three-judge panel of the Court of Appeals ruled Wednesday that only the Legislature can regulate the possession of firearms."


This is good news. There is no reason why a person who has received a concealed carry permit can walk down main street in town with a concealed firearm, but not main street on a college campus.

Perhaps the suit was narrowly-based, or the panel did not won't to open that can of worms.

At one time, I advocated university autonomy as a means of insuring academic freedom. But I learned that autonomy cannot run afoul of state law, even if the laws are obnoxious. Academic freedom (not really an issue, here) must be the responsibility of university governance, and if the state doesn't like it, then that governance must be prepared to take the consequences, however much I might object.

My Dad, who was in academia for the better part of 40 years, noted academic freedom and independence in unlikely places. Part of the reason there was such a flap about integration of the U. of Alabama was the independence that university enjoyed -- and exercised -- during the rule of George Wallace. The president of the University during that time was Frank Rose. Some tales were shared with my Dad about this incident.

I still hope that U. of Florida beats U. of Alabama this Saturday, however.

what makes it terrible? Given that there was zero details explaining how the judges came to that decision, or what Oregon law says, I am guessing since U or O, being a land grant college, is viewed as a quasi or de-facto municipality therefore subject to a state preemption law. If that is the law, I have no idea (I am just kind of speculating). It would be a good ruling. However, if it were a private college then I would agree that it is a bad ruling.
politics and policy opinions should not be a factor, even though we both know judges on both ends of the spectrum do sometimes put ideology before precedent and what is correct.
