Over seven years after 9/11 and we have yet to hear from many key people. For example, the FBI UBLU. There were 18 people in this unit yet I don't think a single person has been interviewed by the US media. Even though the 9/11 Commission turned over their records to the National Archives in August of '04, many key interviews are still pending classification review. Many of the pending reviews are with the same agents the US media evidently has zero interest in interviewing.
may be a factor for some agents. For some reason Judge Hellerstein is unable to make a ruling as to whether FBI and CIA officials will be compelled to testify. The ruling keeps getting delayed. I recall that Judge Hellerstein once told the families something like "Move on with your lives" yet it appears he is the one who keeps postponing this key ruling and the setting of the trial date.
The lawsuits are against the airlines/airline security companies so I'm not sure that FBI/CIA agents are required to remain silent for the purpose of this civil litigation. Strangely, a few months ago Motley Rice attorney Donald Migliori argued against the inclusion of the FBI/CIA testimony claiming it wasn't relevant to the issue at hand. I remarked at the time how odd his view was considering that the families who didn't settle have publicly stated that their goal is to learn as much as possible about the security failures. Though airline company failures are a key aspect (Unsafe at Any Altitude by Joe and Susan Trento is a good book that covers this), the intelligence failures (as in failure to share information for no good reason) are just as important.
If the FBI (and the DOJ, for example SDNY US Attorney Michael Garcia) want to play the "open case/national security" card then they shouldn't also be able to claim the public information is definitive. If all was truly known about 9/11 (especially the conduct of the intel agencies) then there wouldn't be this bizarre reluctance to permit CIA/FBI testimony in the airline civil suits. And key CIA/FBI 9/11 Commission interview summaries wouldn't be classified either.
AFAICT, the airline companies sued to compel FBI/CIA testimony in August of '07. For some reason Judge Hellerstein still hasn't ruled on this motion.
