Antonin Scalia Just Said There's No Prohibition In The Constitution Against Painful Executions?
Does that mean the United States could legally crucify people?

" " starve people to death?

" " poison them?

2. 8th amendment anyone?
Edited on Mon Jan-07-08 06:52 PM by melody
To say nothing of William and Mary's little rebellion.

"cruel and unusual punishment"

And I should add that they'll probably "amend" this with a similarly sociopathic suggestion to
"we don't torture" and "waterboarding is not torture".

6. Yes, maybe Scalia missed that line about "cruel and unusual punishment" being prohibited
A minor oversight; after all, it's part of the Bill of Rights, and Scalia doesn't include those first 10 Amendments as part of the Constitution.

He is beyond reprehensible.

13. "cruel AND unusual"
It doesn't cruel OR unusual. If it is a standard form of capital punishment, it would not be classified as unusual.

20. You must be joking?
If every state disemboweled and drew and quartered, that would not fit your version of cruel and unusual?

Ay yay yay.

21. Pain isn't cruel? Sorry, I think it is. A word like "unusual" needs a broad interpretation
I should point out, I'm against all death penalties except in the case of mass murderers with clear DNA evidence.

5. Phuck Phat Tony
Ask his conscience or soul if painful execution might be immoral. Oh, wait...
(silly of me to even suggest he has a conscience, or soul, for that matter.)

7. as much as I dislike the guy, he's probably right if
what he is saying is that the probhibition on cruel and unusual punishment doesn't guarantee "pain free" punishment.

9. Hey- TONY!
How bout we try it out of YOU, then, you little jaggoff!

Anthony Scallia is a strict constitutionalist. So, fat Tony, also there's nothing written in the constitution that says a fat Italian brain damaged individual can be on the supreme court!

Aaayyyy.... Addia Like-a DAT?

10. I tried to listen to this a little today, but tuned in when they were talking about Veterinary
care.. and I was just afraid I'd lose my lunch if I listened anymore. I couldn't figure out if they were saying that if lethal was good enough for an animal, it was good enough for a human, or what. That death penalty shit gives me the freakin creeps.

18. Scalia (or maybe it was Roberts?) doesn't think the process should be required to be pain-free --
"This is an execution we're carrying out, not surgery."

The milk of human kindness flows not in their veins.

17. I wouldn't think "cruel and unusual" means "pain free."
Crucifiction is unusual and cruel. Poisoning people is also cruel.
But discomfort, slight pain, I don't know if I call that cruel.
