Hillary is for an increase in H1-Bs. Period. As the videos show.

THe simple question is do you want corporate-funded Hillary to remove the tax breaks and outsourcing or do you trust non-corporate funded Barack to do a better job (or do the job at all). Don;t forget Hillary got over $3 million from the American Indian community on the strength of her support for TATA and outsourcing in general to India. She even went there to tout outsourcing!

Not from the sounds of her campaigning to Indian folk here.

The intent of the law as originally put in place was to provide an avenue for American corporations to be able to quickly hire those living overseas possessing unique qualifications (language skills combinations with certain technological skills, etc.) that can't be found here. Unfortunately, this has been warped into getting people that will do work that Americans are able to do, but WON'T do for gutter wages. This is what body shops are all about and have been for the last decade or two. They JUST hire H-1B visa people, so that they have no American workers to compare to to offer a "comparable prevailing wage" as the intent of the law states they should. Therefore they basically pay them what they want, and with the conditions of the VISA have them locked in as "indentured servants" as long as they stay here, with no rights to vote, benefits, and no rights to negotiate salary increases, etc., especially if these body shops offer "services" instead of "contract employees" to contracting companies, which is the typical loophole they've used over the years not to treat them as they would American employees here.

So the H1-Bs are coming, right? Yeah, so lets take them away. No more H1-Bs!!! All the Americans will get those jobs, right?

Wrong.

Apart from the fact that companies have repeatedly documented they can't fill certain positions without the H1-Bs, understand that if there aren't any of those visas, the jobs themselves will go abroad.

So, people living here, working here, paying taxes, contributing to the economy via their skills, and ideas. Or money going abroad to pay for overseas workers? If the H1s go away, these jobs are not going to go to Americans living here. They are going to go away.

There is No Shortage in the US of Highly Qualified Workers.

Study: There Is No Shortage of U.S. Engineers

A new study argues that the offshoring of U.S. jobs is caused by cost savings and not a shortage of U.S. engineers or better education in China. However, the study warns that the United States is losing its global edge.

A commonly heard defense in the arguments that surround U.S. companies that offshore high-tech and engineering jobs is that the U.S. math and science education system is not producing a sufficient number of engineers to fill a corporations needs.

However, a new study from Duke University calls this argument bunk, stating that there is no shortage of engineers in the United States, and that offshoring is all about cost savings.

This report, entitled "Issues in Science and Technology" and published in the latest National Academy of Sciences magazine further explores the topic of engineering graduation rates of India, China and the United States, the subject of a 2005 Duke study.

In the report, concerns are raised that China is racing ahead of both the United States and India in its ability to perform basic research. It also asserts that the United States is risking losing its global edge by outsourcing critical R&D and India is falling behind by playing politics with education. Meanwhile, it considers China well-positioned for the future.

Dukes 2005 study corrected a long-heard myth about India and China graduating 12 times as many engineers as the United States, finding instead that the United States graduates a comparable number.

Since 1985, over 17 million visas have been issued to allow aliens to work in the United States. These nonimmigrant visas, or NIV, are company sponsored visas that use a variety of different names including H-1B, H-2A, H-2B, J-1, L-1, and TN.

In the year 2001, 9 out of every 10 new job openings for computer/IT were taken by H-1Bs, and despite record unemployment the INS issued 312,000 visas in 2002.

By the year 2003 the total number of H-1B visas for high-tech workers issued was greater than the total number of high-tech jobs eliminated. Negative job growth in Computer/IT for U.S. citizens can be directly correlated with the huge influx of H-1B visa holders. If it wasn't for H-1B the unemployment rate for Computer/IT workers would be 0%.

H-1B is used to import workers for jobs that American employers claim can't be filled in the "tight American labor market". Their claim is a lie because there are more than enough Americans to fill these jobs. L-1 visas have no yearly quota and may one day surpass H-1B as a means of importing skilled workers.

NIVs such as H-2A and H-2B are being used to import blue collar and agricultural workers and J-1 visas are used by educational and governmental institutions to import foreign workers. TN (NAFTA) visas are used import Canadian and Mexican citizens to work in the United States.

India plans social security pact with US (H1B's-No SS)

Overseas Indian Affairs Minister Vayalar Ravi said in New York on Friday that New Delhi is trying to negotiate for an agreement with the Bush Administration under which temporary Indian workers in the US would not have to pay social security taxes.

Talking to a small group of Indian journalists Ravi said during the visit of Belgium prime minister Guy Verhofstadt to India earlier this month an agreement, called social security agreement, was signed with Belgian Foreign Minister under which Indians who would work there for less than five years would have the option of paying their social security taxes in India rather than in Belgium.

'We are also negotiating with the United States for a similar kind of agreement,' Ravi said in response to a question. He said such agreements would also be signed with other European Union countries as well following conclusion of negotiations.

For hundreds of thousands of Indian H1B workers in the US, the mandatory payment of social security tax has been an issue since workers who go back to India after six years of temporary employment in the US either voluntarily or due to lack of sponsorship for permanent residency cannot claim the money they had paid from their earnings. For the permanent residents and citizens, social security acts something like a social insurance program at old age.
