1. Not really HIS problem, its the FEC
This is kind of absurd in my opinion. If there was a quorum in the FEC committee he would have been released already, and when there is a quorum he will be released as the committee will recognize his letter that was dated in February. He never took any federal dollars.

He did the same thing Dean did, the only difference is that the committee cannot vote because of a lack of quorum. This a petty attack which will accomplish nothing.

2. Isn't the problem with the FEC rules is that there is no one to enforce the law?
The six-member Federal Election Commission has lacked a quorum since the end of December, when the terms of three commissioners expired. Another seat on the commission remains vacant. That leaves only two sitting members on the agency -- not enough under federal law for the panel to take any action.

"It means there is no one to enforce the law," said Melanie Sloan, executive director of Citizens for Responsibility and Ethics in Washington, a liberal-leaning watchdog group with several election-law complaints pending at the FEC. "It's like the Wild West."

3. One misconception: McCain has not yet opted into the public system for the general, AFAIK
This is only the Republican primary season where he's busting laws right and left. The general would be a whole new game.
