Some interesting tidbits about the latest two lawsuits filed against the DNC.Timelines, coincidences
Edited on Sat May-24-08 04:09 PM by madfloridian
Nothing specific, just stuff in general.

Steve Geller had a private meeting with Hillary Clinton in Broward County a few days ago. Interesting timeline. No further comment.

Geller meets with Hillary

"State Sen. Steve Geller was asked to attend a private meeting with Hillary Clinton this afternoon after her Broward campaign speech. Still an undeclared super delegate, the Senate Democratic Leader from Cooper City was expecting a full court press to win him over to the Clinton camp.

Surprisingly, he said he has not received the same invite from Barack Obama.

“If I had gotten an invitation, I certainly would have gone,” he said.

Geller tomorrow has scheduled a press conference at his law office to announce a “significant development expected to have national impact.”

No, he is not announcing his endorsement in the presidential race. And he probably won’t for some time.

**The next day he announced his lawsuit against the DNC.

He gets to go on Lou Dobbs show so he and Lou and Jeffrey Toobin can talk about how bad Howard Dean is and how it is all his fault, and so Toobin can bring up how bad Barack Obama is and how it is all his fault.

No, I am not exaggerating. Behold the video.

And a couple of new tidbits about the lawsuit filed by Tampa's Victor Dimaio. It is to be heard at 9:30 in the morning on May 28. He has said if it is dismissed, he will immediately use Rule 11 to take it straight to the Supreme Court.

More about the DiMaio lawsuit.

About the DiMaio lawsuit

"A day after a new lawsuit against the Democratic National Committee was filed for its refusing to recognize Florida’s delegates from its January primary, a court date was set for the first legal action taken against the national party.

Tampa Political consultant Vic DiMaio originally sued shortly after the DNC announced last August that it would penalize the state Democratic Party for moving its primary date up. It was originally dismissed by a Tampa court, but was heard by a US appellate court in March – and today DiMaio’s attorney, Michael Steinberg, announced DiMaio will go to court next week in Tampa Federal district Court. The court date does come just days before the Democratic National Committee’s Rules and Bylaws Committee convenes to deal with the matter of Florida’s – and Michigan’s Congressional delegation.

This week Barack Obama said he was open to accepting a compromise of counting half the delegates, but the Hillary Clinton camp and other advocates for Florida say they want all of the votes to count. (Not quite true...Bill Clinton said 50% seating was fair.)

Dimaio's attorney says even if the party gets together with a solution he will pursue his lawsuit anyway.

DiMaio’s attorney, Michael Steinberg, who is now the Chairman of the Hillsborough County Democratic Executive Committee, says he’s hopeful that the party can come together regarding the delegate issue. But, he says he will pursue his lawsuit anyway.

Steinberg is accusing the party of trying to be racially diverse by adding NV and SC in the pre-window. Trouble is, in his eyes, that is not legal. Even though the DNC says it also geographically diverse...he says wrong, race was first and that makes it illegal.

But Attorney Michael Steinberg says that in reviewing the lawsuit filed by Florida Senator Bill Nelson and Congressman Alcee Hastings, which has also been thrown out, that he realized that the DNC acknowledges that race was a factor in selecting South Carolina and Nevada to be allowed to move their primary dates up.

I find it repulsive to use those grounds for a lawsuit. The party tries to be diverse, gets sued. If they let two small white states continue to go first...they get condemned.

I know how loudly Steve Geller is braying that he has not endorsed. Okay, well....every action these guys are taking is to the benefit of only one candidate. So, go figure.

I thought this paragraph was interesting.

Throughout the 10 months since DiMaio originally filed suit, he has insisted that he hasn’t had a dog in the hunt, so to speak. But recently, he appeared on a local television talk show where he argued that Hillary Clinton would be a stronger candidate in the fall against John McCain. And unsolicited, he mentioned Obama’s decision in Michigan.

Vic DiMaio "goes before Judge Richard Lazarra at 9:30 in the morning next Wednesday in Federal Court in Tampa."

Governor Dean, when your term is up trying to cater to people who harbor nothing but ill will for you and for the party itself....just head back to Burlington and DFA..cause we won't pick on you.

This is just ridiculous stuff.

25. Wasn't Hillary the only one who campaigned in Florida? I wonder
if she did that purposely in case she got into the very situation she is in now.

And notice that she is not screaming about Michigan anymore?

27. I just don't understand what all the fuss is about
The Party had very clear, unambiguous rules; the Florida and Michigan parties deliberately broke those rules. That the state held an earlier primary was irrelevant; the Washington party has always ignored the state primaries and instead used caucuses to select delegates, so that was always an option. Further, the US Supreme Court has already ruled that parties have a constitutional right to determine their candidates. If a state party deliberately violates national rules, I fail to see how the national party can be required by any law or judicial ruling to accept the results of an invalid vote; that would be a violation of the national party's freedom of assembly.

So why the bloody hell is this nonsense being allowed to continue?

2. Florida (and Michigan) broke the clearly defined rules. They are trying to make
a case (justify) for breaking the rules.

The real question should be - what is the appropriate penalty for states that pull these shenanigans?

4. An imaginary hearing....
Judge: Why is the plaintiff filing this suit?

Plaintiff: Because the DNC told us if we moved our primary, the results wouldn't count and our delegates would not be seated.

Judge: So what happened then?

Plaintiff: We moved our primary, and the results didn't count and the delegates have not been seated.

Judge: Case dismissed. Next....

5. Geller knows that the DNC will humiliate on national TV on 5/31
so he's just trying to look combative early by getting these shots in. No doubt that Howard Dean will invite all the cameras into the 5/31 hearing and make sure they see the video of Geller mocking the DNC. His ass is grass!

33. Once these sharks got into the Fed court system they know they
are swimming with fellow sharks in pug waters; So I would not count on any fairness from here on out. Nelson is one of the biggest DINO's in the senate. IMO the reason DINO's and pugs are trying so desperately to destroy H Dean is because he is beating them in their own back yards where they thought they were safe; But as evidenced by the last few special elections they are fighting with all they have, the man responsible for those wins; H Dean.

36. Oh, good. The Field picked up on the Geller/Clinton meeting
the day before the lawsuit was filed.

Send in the Clown

No three ring circus - like the one that Senator Clinton is ginning up regarding the Florida and Michigan non-binding straw polls last January - would be complete without a clown.

And right on cue, enter Florida State Senator Steven Geller:

Sen. Steve Geller, D-Cooper City, filed a federal lawsuit today force the national Democratic Party to recognize the 1.75 million votes Floridians cast during the Jan. 29 primary and seat the state’s delegation at the convention.

Here is the same Senator Geller, caught on videotape, during the proceedings in the Florida Senate that led to the the illegitimate January 29 “primary” upon which he wants the Florida delegation based and seated. He cues the video I call the bramble bush

"Note how he was mocking and gaming the system even back then.

His lawsuit, by the way, is a non-starter: the courts have always ruled that political parties get to define their own internal decision-making procedures, including with presidential nominations.

Update: Guess who met with Senator Geller, yesterday?

It doesn't count in the numbers and he can pretend he is objective and make a big splash.

For a small time con man he has done pretty well in that small pond.

I love it that Obama campaign didn't bother to call him back. I hope they snub the hell out of him for 8 years the parasite.

It started the day after the sanctions. The emails started out from the county chairs to stop funding the DNC.

I saw this on a Florida blog...

"CNN's Susan Candiotti is reporting on CNN radio that Dimaio will file a simultaneous appeal to the Federal Appeals Court in Atlanta and the U.S. Supreme Court.

Posted by: fldem | May 28, 2008 at 12:23 PM"

Maybe they will keep filing until Hillary drops out.
