It was pretty clear he had the goods on Cheney, and decided not to 'go there'

He had evidence that, at least, suggested a criminal activity by VP Cheney. And no indictment was returned. There are two possibilities: (a) he did not think it was enough to gain a conviction; or (b) the grand jury did not vote in favor of an indictment.

He also had more evidence of Cheney abusing the power of his office. In fact, the possible criminal activity tended to fall into this category.

Mr. Fitzgerald made clear that he believed the Congress should investigate Cheney's role in the Plame scandal. Though Mr. Fitzgerald could not prosecute abuses of power, Congress can and should.

The Bush Department of Justice blocked Mr. Fitzgerald with sharing fully with Congress the full scope of his grand jury investigation, as it related to Cheney and Bush. Mr. Fitzgerald did not have the legal authority to override the DoJ. The Congress absolutely had the power to override the DoJ, and plenty of legal precedent that would insure they won in federal court, had they actually been serious about investigating "high crimes and misdemeanors."

Hence, I respectfully disagree with you here. It was the Congress that didn't want to go there.

With all of the political investigations Fitzgerald has undertaken it would look suspicious of he does not. Even kicking Fitzgerald "upstairs" would look bad, IMHO. BTW, it's been reported that Obama pledged to keep Fitzgerald as USA of the Northern District.
