Republicans See NY-20 Settled by Judges

For those who hoped to see a winner in NY-20, don't expect one very soon. Politico obtained an email from the NRCC which insists, "The election will most likely be decided in the courts."

Nonetheless, "even the most pro-Tedisco rulings by the court will still make it difficult for Tedisco to overcome the narrow deficit he's currently facing. If the remaining ballots don't dramatically break Tedisco's way, it will be interesting to see how he proceeds. Will he challenge the validity of the count and continue to press his case in the courts, or begin preparing for a rematch against Murphy next year?"

The vote count as this morning shows Scott Murphy (D) leading Jim Tedisco (R) by 178 votes.

1. NY elections are a little easier than most because of the machines.

There are no paper ballots other than absentees. We use mechanical machines. The machine spits out the numbers and it is what it is. The only common mistake is reporting the wrong numbers on the wrong lines. This happened between Hillary and Obama. Hillary would get 80 votes and Obama would get 8, when in reality Hillary 200, Obama 220, Edwards 80, Dodd 8.

178 votes is easily within the realm of a mistaken report. I don't know if the machines have been recounted yet.

2. Improper maintenance may mean lost votes, but improper reading of tallies gets checked.
!00% recanvassing and observance of a mechanical lever process vs concealed paper ballot vote counting, with a 3% spot check to be done within 14 days. Lever elections feature more election night certainty, before the media declares a winner.
