Who cares what Joe the plumber thinks. Granted I don't listen to what he has to say, but I'm sure he doesn't have much to say based on the few comments that get aired. As to your other point, threatening a public official, President to police officer and everything in between, has never been protected speech. The authorities could easily lock this guy up and still be in compliance with constitutionally protected speech.
